Terms of Use for visitors, exhibitors and users
WE KINDLY ASK YOU TO READ THESE TERMS OF USE AND OUR PRIVACY POLICY (AVAILABLE HERE ) AS CAREFULLY AS POSSIBLE. IF YOU DO NOT AGREE WITH THE TERMS OF USE OR PRIVACY POLICY, YOU SHOULD NOT ACCEPT ANY trendfairs OFFERS.
On the following pages you will find the General Terms of Use (hereinafter referred to as "Terms of Use") of our company, trendfairs GmbH, with its registered office at Kurgartenstraße 37, 90762 Fürth, Germany (hereinafter referred to as "trendfairs"/"We"/"Us"). Detailed contact data and information on commercial registration as well as legal representatives can be found in the imprint section. The terms “user” and "you" shall hereinafter refer to all visitors, exhibitors or users of our trade fairs and other events, including follow-up events (hereinafter referred to as "trendfairs events") and our websites (currently www.trendfairs.de, www.area-30.de, www.cube30.de, www.kuechenwohntrends.de, www.kuechenwohntrends.at, www.siex.ch, www.world-of-fireplaces.de, kuechenherbst.online) and online offers (hereinafter referred to as "trendfairs websites"). The Terms of Use shall form the legal basis for visiting or using trendfairs events and trendfairs websites (hereinafter jointly referred to as "trendfairs offers"). The Terms of Use, our data protection provisions and, in addition, all other (in particular legal) regulations applicable to the use of trendfairs offers shall apply to users. If you continue to access the trendfairs websites, register via the trendfairs websites or use the trendfairs websites in any other way or attend trendfairs events, you expressly agree to the aforementioned conditions and regulations. Any deviating terms and conditions of the user shall not be recognised and are hereby expressly rejected. Deviations from the Terms of Use shall only be effective if they have been previously confirmed in writing by trendfairs. Users shall not be permitted to use trendfairs offers for purposes which are unlawful or illegal, or which violate the Terms of Use. In particular, the trendfairs websites and their associated networks may not be damaged, deactivated, overloaded or impaired.
VISITOR REGISTRATION, TICKETING
Participation in a trendfairs event as a visitor shall generally require the user to register as a visitor to trendfairs events either on site at a trendfairs event or via the trendfairs websites. The prerequisite for registration is that the user is a trade visitor (exception is made for the trendfairs event küchenwohntrends in Munich). In this case, registration is also possible for private individuals. In the case of registration of trade visitors, the following shall also apply, i.e. the user is an entrepreneur within the meaning of Section 14 BGB (German Civil Code), i.e. a natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in exercise of his/her commercial or independent professional activity. The user is obliged to provide correct and complete information on all aspects relevant for registration, including personal data and all data concerning the user's affiliation to one or more companies. By registering, the user expressly affirms that he/she is an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB). trendfairs reserves the right to request appropriate evidence from users to verify registration data, and to correct incorrect information immediately.
In the event of successful registration, trendfairs shall create a personal online account (hereinafter referred to as "user profile") for the user on the trendfairs websites, via which the user may, among other things, request tickets for specific trendfairs events. The user's access authorisation for trendfairs events may be made dependent on further accreditation criteria (e.g. status as a trade visitor, representative of the press, etc.); details can be found on the relevant trendfairs websites or in the user profile. trendfairs reserves the right to request suitable evidence from the user to verify the accreditation criteria, and to correct incorrect information immediately.
The registration of private individuals for küchenwohntrends in Munich shall be excluded from user profile creation.
For the trendfairs events accessible to the user, trendfairs shall provide a ticket personalised to the user on the user profile, which entitles the user to participate in the event upon presentation of valid proof of identity. The user may present the ticket itself either in printed or digital form, whereby the user shall be responsible for ensuring the necessary legibility. The user will also receive a personalised ticket with a QR code for the scanning function, which is explained in more detail in our Privacy Policy under the section entitled "Disclosure of Data to Third Parties". Any disclosure or transfer of tickets or name badges to unauthorised third parties is expressly prohibited.
In the case of chargeable trendfairs offers, the following paragraph shall additionally apply:
Offers and prices for trendfairs events are always subject to change. The prices shown include the statutory Value Added Tax applicable at the time. Payment for online tickets shall, in the event of an order, be made by credit card, PayPal or invoice via external service providers, and by making a payment, the user agrees to the processing of data (if applicable, personal data) provided by him/her which is necessary for the respective contract or payment processing. A return or refund of already received and/or paid trendfairs offers shall be excluded in principle. In the event of a successful order, the user shall receive an order confirmation by e-mail. All invoices shall only be sent to the user by subsequent e-mail as a PDF file and, where necessary, by post at the special request of the user. By placing an order, the user declares his/her consent to invoicing and dispatch purely by electronic means, i.e. there shall be no entitlement to invoicing in paper form. trendfairs shall accept no liability whatsoever for invoices or input tax deductions that are not recognised by the tax office, unless the non-recognition is due to reasons for which trendfairs is culpably responsible. Furthermore, trendfairs shall not be liable for errors and/or damage caused by the invoice recipient's lack of or improper cooperation or inadequate technical equipment in connection with the documents transmitted to him/her electronically.
For the avoidance of doubt, the user shall not acquire any legal claim to an access authorisation for trendfairs events or to the provision of the user profile or tickets or name badges. trendfairs reserves the right, in particular, to offer participation in trendfairs events only against payment, to change the above-mentioned accreditation criteria or the registration process at any time, or to redesign or delete the user profile at its own discretion, to send tickets by post, to cancel trendfairs events, or to withdraw the user's entitlement to participate in trendfairs events, whereby in the case of paid trendfairs events, any amounts already paid for tickets shall be refunded at face value.
INFORMATION, NEWSLETTER
By registering for a user profile (see above), the user expressly agrees that trendfairs may contact the user in various ways based on the data provided by the user (e.g. by post, e-mail, telephone and social networks) within the scope of implementing the contract.
Provided that the user has actively declared his/her consent to this (Article 6 (1) point a of the GDPR), trendfairs shall regularly send him/her an e-mail newsletter in order to inform the user about important or interesting topics in connection with trendfairs and companies associated with trendfairs, as well as our exhibitors and selected partners. In order to obtain the user's consent, trendfairs shall use the double opt-in procedure, i.e. trendfairs shall only send the user a newsletter if the user activates trendfairs' newsletter service by entering his/her e-mail address on the trendfairs websites or when creating the user profile or in a corresponding notification e-mail from trendfairs by ticking a box or clicking on a link. Should the user no longer wish to receive newsletters from trendfairs, he/she may object to further receipt at any time. To do so, the user can use the unsubscribe link provided in each newsletter, as well as the corresponding function in the user profile. Any other notification in text form to trendfairs, e.g. letter, fax, e-mail, shall also suffice, optionally using the following contact details:

If the user unsubscribes from the newsletter via one of the above-mentioned available methods, he/she will not receive any further newsletters and his/her data provided for the purpose of subscribing to the newsletter will be deleted, whereby data stored by trendfairs for other purposes (e.g. information for the user profile) shall remain unaffected by this.
DISCLAIMER
All trendfairs offers are fundamentally subject to change and are non-binding. All information on our websites is subject to constant change and is regularly checked to ensure that it is up to date. trendfairs does not, however, accept any liability for the correctness, completeness, accuracy and up-to-dateness of the information and data. trendfairs expressly reserves the right to change, supplement or delete the trendfairs offers, in whole or in part, or to temporarily or permanently discontinue publication or availability without any separate announcement. If a previously announced trendfairs event is cancelled or does not take place, registered users shall be informed immediately, unless they have expressly and separately objected to receiving notifications or newsletters from trendfairs. trendfairs shall, however, in no case be liable for costs and/or expenses incurred by users due to the cancellation or non-implementation of a trendfairs event. Moreover, trendfairs shall be subject to statutory liability only in the event of intent and gross negligence, as well as in the event of damage resulting from injury to life, limb or health of persons, and otherwise only in the event of breach of a material contractual obligation, the fulfilment of which is a prerequisite for the proper performance of the contract and on the observance of which the user may regularly rely (cardinal obligations), whereby the amount of liability shall be limited to the damage foreseeable at the time of conclusion of the contract and typical for the contract. For slight (i.e. simple) negligence, trendfairs shall be liable in accordance with the Product Liability Act. Beyond this, any liability on the part of trendfairs and its vicarious agents shall be expressly excluded.
Pursuant to Section 7, Paragraph 1 of the German Telemedia Act (TMG), trendfairs, as a service provider, shall be responsible for the information provided for use on the trendfairs websites in accordance with general legislation. In accordance with the requirements of Sections 8 to 10 of the TMG, trendfairs as a service provider shall not be obliged to monitor the information it transmits or stores, or to investigate circumstances that indicate illegal activity. This shall not affect the service provider's obligations to delete or block the use of information in accordance with general laws, whereby liability in this respect shall only come into consideration from the point in time at which a concrete infringement of the law becomes known. In the event that specific legal violations become known, trendfairs shall immediately delete the relevant information or block its use. trendfairs shall have no influence on the content of any external third-party websites linked to the trendfairs websites, i.e. as a matter of principle, the respective service providers or operators shall be responsible for the content of such external websites, and trendfairs shall not assume any liability for such content. Insofar as the trendfairs websites contain links to external websites of third parties, the linked websites were checked for illegal content when the respective links were created and no illegal content was identifiable at that time. However, trendfairs shall not be obliged to permanently monitor the content of linked external third-party websites beyond this, independently of concrete indications of a legal violation; however, trendfairs shall immediately delete links to external third-party websites in the event that infringing content becomes known. trendfairs shall not be responsible for the content of third-party websites that refer to the trendfairs websites.
PROTECTED CONTENT
trendfairs and all trendfairs websites are protected by copyright - © 2018 trendfairs GmbH. All rights reserved. The trendfairs websites and their contents (e.g. texts, images, graphics, layouts) are fundamentally (i.e. insofar as they are protectable) subject to the protection of intellectual property, in particular the regulations of copyright and trademark law. The modification, duplication, dissemination and making publicly available of the contents of the trendfairs websites protected in this respect, in particular for commercial purposes, shall not be permitted. The foregoing shall also apply in principle to content on the trendfairs websites which has not been created by trendfairs itself. In the event that the provision of certain content on the trendfairs websites may violate the rights of third parties, we request that you notify us accordingly; trendfairs shall remove any illegal content without delay.
AUDIO, VISUAL AND AUDIO/VISUAL RECORDINGS DURING trendfairs EVENTS
During trendfairs events, trendfairs or persons commissioned by trendfairs (e.g. trade fair photographers) shall make audio, visual and audio/visual recordings of the event. In this respect, by participating in a trendfairs event, the user irrevocably consents to audio and audio/visual recordings being made during the trendfairs event, on which he/she may be seen and/or heard, and irrevocably grants trendfairs the unlimited and transferable right to process the resulting recordings, on which he/she can be seen and/or heard, and to use them free of charge within the scope of an event review, company presentation and for advertising the trendfairs offers on the trendfairs websites, in exposés, brochures, presentation videos and via social media.
Furthermore, in connection with the production of audio and audio/visual recordings during trendfairs events, we would also like to point out the following in order to avoid misunderstandings: Productions for TV, video and new media as well as the taking of photographs of stands, in particular of exhibits, including for private purposes, are only permitted if the exhibitor concerned has expressly consented in advance to the making of audio and audio/visual recordings of his/her stand, products and/or staff. The filming, production of audio and audio/visual recordings for commercial purposes shall require the prior written consent of trendfairs in all cases, and - insofar as exhibitors' stands/products are concerned or other rights (in particular personal rights) of third parties are affected - the prior consent of the respective exhibitor or rights holder.
DATA PROTECTION
The protection of personal data is an important concern for trendfairs. For this reason, the trendfairs websites and offers comply with the applicable data protection laws. Further information on this can be found in our data protection regulations.
OTHER PROVISIONS
The contractual relationship between the user and trendfairs shall be governed exclusively by the laws of the Federal Republic of Germany, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
The place of jurisdiction for all legal disputes arising from these Terms of Use or the use of the trendfairs websites shall be Fürth, if the contracting parties are merchants, legal entities under public law or special funds under public law, or if at least one of the contracting parties does not have a general place of jurisdiction in the Federal Republic of Germany, or if, after conclusion of the contract or notification of these Terms of Use, the contracting party relocates its domicile or usual place of residence outside the Federal Republic of Germany, or if its domicile or usual place of residence is unknown at the time of the commencement of proceedings. Furthermore, trendfairs shall also be entitled to bring an action at the user's general place of jurisdiction.
The place of performance for all obligations arising from these Terms of Use shall be Fürth.
Should one or more provisions of these Terms of Use be or become invalid in whole or in part, the remaining provisions of the Terms of Use shall remain valid. The invalid provision shall be replaced by another provision that comes as close as possible to the purpose intended by the invalid provision.
